Terms and conditions
These terms apply to the use of sona-motion.ai and to contracts for the SonaMotion AI phone assistant between Freicon Software GmbH and business customers.
1. Scope
Only these terms apply. Deviating customer terms become effective only if we confirm them expressly in text form. Our offering is addressed to businesses, not consumers.
2. Services
We provide the SonaMotion AI phone assistant as a cloud service (software as a service), including setup, configuration and support in the agreed scope. The exact scope follows from the selected package (Starter Lite, Starter, Business, Premium, Enterprise) and the order confirmation.
3. Availability and customer cooperation
We operate the service with standard industry care and schedule maintenance outside main business hours where possible. The customer provides the access required for integration (phone system, DMS, calendar) and the necessary process information.
4. Prices and payment
The prices agreed at conclusion of contract apply, plus statutory VAT. Unless agreed otherwise, billing is monthly in advance; one-off setup services are invoiced on delivery.
5. Term and termination
Unless agreed otherwise, the contract runs indefinitely and may be terminated by either party with one month's notice to the end of a month. The right to terminate for cause remains unaffected. Termination requires text form.
6. Data protection
Where we process personal data on behalf of the customer, the parties conclude a data processing agreement under Art. 28 GDPR. Conversations are processed in the EU and transmitted and stored encrypted.
7. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of material contractual obligations, limited to foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected.
8. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is, as far as permitted, the registered office of Freicon Software GmbH.
